The Fourth Circuit, per Supreme Court potential nominee Michael Luttig, reversed the the South Carolina district court's decision that rejected Pres. Bush's determination that Jose Padilla -- the American al-Qaeda operative held by the Defense Department -- is an enemy combatant. The Fourth Circuit made clear that the District Court's decision, from its premises to its conclusions, had no merit.
Most notable, to me, were three of the amici curiae for Jose Padilla: Janet Reno, Philip B. Heymann and Eric Holder -- the former Attorney General and two deputy AGs in the criminal division of the Justice Department under Reno.
